06Disclaimer of Warranties

DODA VERIFY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF:

  • MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
  • ACCURACY OR COMPLETENESS OF DODA STATUS DATA RETRIEVED FROM SAT. DATA IS PROVIDED IN REAL TIME FROM THIRD-PARTY GOVERNMENT SYSTEMS OUTSIDE OUR CONTROL.
  • UNINTERRUPTED OR ERROR-FREE SERVICE.
  • SECURITY OF DATA TRANSMISSION BEYOND OUR REASONABLE PRECAUTIONS.

You acknowledge that DODA status information is sourced from Mexico's SAT and may reflect delays, inaccuracies, or outages in that system. DODA Verify is a convenience tool and does not constitute legal or customs advice.

07Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIGITAL CROSSBORDER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  • LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.
  • DAMAGES ARISING FROM RELIANCE ON DODA STATUS DATA THAT IS DELAYED, INACCURATE, OR INCOMPLETE DUE TO SAT SYSTEM ISSUES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF DODA VERIFY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

08Dispute Resolution — Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Digital Crossborder agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of DODA Verify (collectively, "Disputes") will be resolved by binding arbitration on an individual basis, rather than in court, except that:

  • Either party may bring an individual claim in small claims court.
  • Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent imminent harm.

Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or Commercial Arbitration Rules for business accounts), available at adr.org. The arbitration will be conducted in English, and the seat of arbitration shall be Brownsville, Texas, USA (or by videoconference if both parties agree).

The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

09Class Action Waiver

YOU AND DIGITAL CROSSBORDER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If this class action waiver is found unenforceable for a particular claim or dispute, then only that claim or dispute shall be removed from arbitration and may be litigated in court, with all other claims remaining in arbitration.

10Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. To the extent that any dispute is not subject to arbitration under Section 08, the parties consent to the exclusive jurisdiction of the state and federal courts located in Cameron County, Texas (Brownsville, Texas).

The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.

11Intellectual Property

DODA Verify, including its software, design, trademarks, and content, is owned by Digital Crossborder and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service for its intended purpose.

You retain ownership of any data you input into the service (DODA numbers, references, etc.). You grant Digital Crossborder a limited license to process this data solely to provide the service to you.

12Termination

We may suspend or terminate your access to DODA Verify at any time, with or without cause or notice, including for violation of these Terms. You may terminate your account at any time by emailing customerservice@dodaverify.com.

Upon termination, your right to use the service ceases immediately. Sections 06 (Disclaimer), 07 (Limitation of Liability), 08 (Arbitration), 09 (Class Action Waiver), and 10 (Governing Law) survive termination.

13Changes to These Terms

We may modify these Terms at any time. We will provide at least 14 days' notice of material changes by email or by posting a notice on dodaverify.com. Your continued use of DODA Verify after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the changes, you must stop using the service before the effective date.
